Marriage is half of the deen, and it is one of the greatest blessings Allah (SWT) has placed in this life. We are honored that you are considering Zaid Community Center to officiate your Nikāh, and we ask Allah to make this union a means of tranquility, love, and mercy for you both. Ameen.

This page outlines the Islamic and administrative requirements for performing a Nikāh at ZCC. Please read it carefully before submitting your application.

1. What Is a Nikāh?

The Nikāh is a sacred contract between a man and a woman who are lawfully permitted to marry under Islamic Law (Shari’ah). It establishes a lawful bond rooted in love, mercy, and mutual rights, and is one of the most beloved acts of worship in the sight of Allah (SWT). A Nikāh is a binding covenant and should be approached with sincerity, respect, and full compliance with both Islamic guidelines and the policies of this masjid.

2. Legal Status in the United States

A Nikāh alone does not constitute a legally recognized marriage under U.S. law. All couples intending to have their Nikāh performed at ZCC must obtain a valid marriage license from the Gwinnett County Probate Court (or your local county) and present it to the officiating Imam prior to the ceremony.

ZCC does not officiate Nikāh ceremonies involving:

Polygamous marriages
Inter-religious marriages (including where the bride is non-Muslim)
Remarriages between former spouses whose previous marriage was dissolved through an irrevocable Islamic divorce (talaq ba’in)

These policies ensure both legal compliance and the protection of all parties in accordance with Islamic principles.

3. Islamic Requirements for a Valid Nikāh

In accordance with the traditional jurisprudence of all four Sunni schools (Hanafi, Shafi’i, Maliki, Hanbali), a valid Nikāh requires four essential parties: the Wali (guardian of the bride), the groom, and two qualified male Muslim witnesses. A Mahr (dowry) must also be agreed upon.

3.1 Wali (Guardian of the Bride)

The consent and presence of a qualified Wali is a mandatory condition for the validity of the Nikāh. The Prophet ﷺ said: “There is no Nikāh without a Wali and two witnesses” (Jami’ at-Tirmidhi).

The Wali must be:

A Muslim male of sound mind
Of upright moral character, known for his adherence to Islamic obligations
The bride’s closest male kin, beginning with her father, then eldest brother, then paternal uncle, in that order

If the Wali is deceased or is disqualified (for example, non-Muslim), the Imam of the bride’s local recognized masjid may assume this role. In cases where no such authority is available, the Imam of ZCC may serve as Wali after formal review and prior approval. Women may not serve as Wali.

3.2 Ijab wa Qabul (Proposal and Acceptance)

The Nikāh is executed through the formal exchange of Ijab (proposal) by the Wali on behalf of the bride, and Qabul (acceptance) by the groom, in the presence of the two witnesses.

During the ceremony, the officiating Imam will ask the Wali whether he offers the bride in marriage to the groom for the agreed-upon Mahr. The Wali will respond in Arabic: “نعم، أنكحتُها” (“Yes, I have given her in marriage.”) The statement is made once; there is no need to repeat it.

3.3 Witnesses (Shahadah)

Two adult Muslim men must serve as witnesses. They must be:

Practicing Muslims who consistently fulfill their obligatory acts of worship (the five daily prayers, Zakah, fasting Ramadan, etc.)
Of upright and trustworthy character
Free from involvement in open sin or immorality

The Wali does not count as a witness.

3.4 Mahr (Dowry)

The Mahr is a required gift from the groom to the bride and belongs exclusively to her. The amount must be agreed upon before the ceremony and recorded in the official Nikāh documentation.

If no amount is specified, the default will be the Mahr Fatimi, which is the historical Mahr paid by Ali (RA) to Fatimah (RA), approximated today at $1,200 USD and payable immediately upon execution of the Nikāh.

We strongly discourage excessively burdensome amounts, following the Prophet’s ﷺ guidance to make marriage easy. The Mahr may not be withheld or reduced without the bride’s express consent.

In the case of a Khul’ (annulment initiated by the wife), the Mahr must be returned to the groom in exchange for release from the contract, subject to the approval of the officiating Imam.

4. ZCC-Specific Requirements

The following requirements are specific to Zaid Community Center. Failure to adhere to these will result in cancellation of the Nikāh ceremony.

Marriage License. A valid U.S. marriage license must be obtained prior to the Nikāh and presented to the Imam for signing.

Application Submission. All Nikāh ceremonies must be scheduled using the official online application form (linked below). Submission does not guarantee booking. A date and time is only officially reserved after written confirmation from the Imam via email.

Gender-Based Seating. Men and women will be seated separately during the ceremony, in accordance with Islamic adab. Proper hijab is required.

Photography. Out of respect for the sanctity of the masjid and the privacy of attendees, photography on the masjid premises is limited to the bride, groom, and their immediate families only. Professional photography and videography require prior approval from the Imam.

Public Displays of Affection. No romantic or intimate physical gestures are permitted on masjid grounds. Please maintain appropriate Islamic decorum (haya) throughout the ceremony.

Wedding Decorations. Decorations are not permitted inside the prayer hall. Simple, modest arrangements in the lobby or entryway may be permitted with prior approval from the Imam.

Food and Beverages. No food or drinks are permitted inside the musalla. If the family wishes to distribute or share food within the masjid, a $200 refundable security deposit is required and must be arranged in advance. If no food is being distributed, this deposit does not apply.

Written Contract. A formal Nikāh contract provided by ZCC must be completed and signed by the Wali, bride, groom, two witnesses, and the officiating Imam.

Officiant. Nikāh ceremonies at ZCC are officiated by Qari Akib Sahriar or Imam Yahya Saeed. No outside officiants are permitted on masjid premises without prior approval.

5. Fee

A fee of $500 (cash) is requested for the Nikāh ceremony. This fee covers the service preparation and time of the officiating Imam, and helps support the ongoing programs of Zaid Community Center.

6. How to Apply

To request a Nikāh at ZCC, please complete the following two steps:

Submit the online Nikāh application form (linked below).
Wait for written confirmation from the Imam. Please allow up to 72 hours for a response.

Once confirmed, you will receive instructions on next steps, including submission of your marriage license and the Nikāh contract.
